Several of the UAE Free Zones now permit re-domiciliation, making the UAE a popular jurisdiction for companies looking to move to the region.

The choice of jurisdiction where to redomicile the company will depend on several factors such as the nature of the business activity of the company, the specific requirements of each Free Zone, the location of the Free Zone, and the type of law applied.

A company that re-domiciles to the UAE must first obtain the written approval from the emigrating State (jurisdiction where the company is currently registered).

Factors to consider before a re-domiciliation

Before initiating any re-domiciliation process, it is highly recommended that the company understand the impact of the re-domiciliation on its finance agreements, material contracts and employees (residence visas and work permits). If the company has subsidiaries and branches, the impact of the re-domiciliation on these entities will also need to be considered. Additional factors to consider:
